Trex Class Action Lawsuit

The following was posted to Facebook from a user group created by angry Trex Deck owners:

"Talked to a gentleman from the attorney's office of Hagens Berman in, I believe California, that is suppose to be handling the lawsuit against TREX.  He claims that th class action lawsuit should be starting very soon.  I told him I had filed for acceptance to the suite and he sent me a questionnaire to fill out and return.  We talked about all the people having issues with TREX and the problems with the mold returning in 6-8 weeks after cleaning.

I also mentioned that when I purchased TREX ACCENT decking in 2007, I was not given any form of warranty and never told about Mold issues or so called "low maintenance" decking.  I was sold on the "maintenance free" decking.  Matter of fact I never received any form of warranty explanation until I filled out a TREX questionnaire and complaint form...they happily slipped one in their return mailing to me...oh, and with denials of any wrong doing."

I have asked this user to keep the group updated regarding this class action.  If it becomes anything I will post information here.

  2. Did this class action lawsuit already take place? I am looking for information on how to handle my situation: I bought my house in 2010 and it had an existing bi-level original trex deck which the seller had installed in approximately 2003/4. I did notice that the trex had black and green spots, and just figured it was dirty since the seller appeared to be somewhat of a negligent slob. Last year I had it powerwashed professionally, and it looked good, so I thought the "dirt" problem was fixed. However, as I know know from doing research, it was mold, not dirt, and like everyone else reports, the mold has returned even worse than it was. it is the original first generation ugly cardboard color looking trex. Now it is decorated with disgusting big black mold spots everywhere. My issue is that since I did not purchase the trex, nor was I the one to have the deck installed, I have no receipts or prrof of purchases or anthing I might need to get in on one of these class action suits or to fight with the Trex company. The only thing I would be able to produce is pictures. Looks like I'm stuck with this moldy crap since I cannot afford to have the deck ripped out and replaced without any type of compensation. Looks like I'm dead in the water with no proof of purchase...any suggestions?

  3. Unfortunately, the class action lawsuit seems to be a lot of nothing. Several users in our facebook group have tried to contact the offices of Hagens Berman and recieved no information on the status. If you know of an attorney, it might be worth it to run your issue by them to see if they think you have a case. With Trex warranty they pretty much have themselves and their shoddy product covered against and legal liability. The mold, while disgusting, poses no health risks (supposedly). So their suggestion is to live with the mold or spend a lot of money cleaning it.

    1. Hi Jennifer. My husband and I live in Preston WA. We purchased Trex in 2008 to replace our rotted second growth cedar decking. It was soon moldy, spotted, flaking and discolored. We were dealing with aging and dying parents on both sides as well as aging and dying pet horses and donkeys. We were aware that Trex was under scrutiny but lost track of where things were. Now we are trying to figure out how to deal with the mess that Trex left us in. Please contact us so we can join with the class action suit you are developing.

  5. I am so frustrated with my Trex Deck. I purchased Trex less then 2 years ago. With in 2 week of installation the nice brown color turn into a very light tan. Within 1 month the light tan turned into a splotchy black mess. I cleaned it with the recommended deck cleaner and a pressure washer. With in 2 weeks the black mold returned. If I had not spent $10,000 on this decking I would rip it up and go back to wood. At least with wood I only needed to treat it once a year and not every 2 weeks.

  6. I, too, am very frustrated with my TREX DECK. Mine has not only mildew/mold, but is falling apart !! The individual pieces are decaying - turning into sawdust. It was my understanding that it was not only low maintenance, but also guaranteed for 20 + years. I'm pretty sure that I have my receipt (which is from 2007, I think) - I will look to see if I kept the brochure also.
    I definitely want to be included in the lawsuit!! Please post an address so that I may be included.

  7. I installed a new trex deck a couple of years ago and have had to tear it out as it swelled so bad that all the gaps closed off leaving me a small lake on my deck. The side boards swelled and warped. The product is garbage only after a couple of years. I am reinsalling it with larger gaps to get me through a couple more years (I hope). I will replace with a wood product in the future. At least that has a long track record.

  8. Like the rest of you, I have also experienced severe mold issues with my TREX decking. I had it installed in 2010 and now it looks horrible. I spent over $10,000 for the material alone, which in addition has also faded considerably.
    I understand that there are some attorneys looking to start a class action law suit in the US. I am in Canada. Is there anyone looking after Canadian interests?

  9. Ditto all the way around. We are near Issaquah WA. We purchesed our Trex in 2008. The deck is moldy, swollen and flaking, not to mention discolored. We would love to join a class action suit against Trex. Way over-sold and over-promised - JUNK!!!

  10. My trex decking has mushrooms growing on the surface. As I looked up how to clean them, I am realizing this is not about mushroom removal, but a defective product. This product was sold as maintanence free, but the resulting rot on the facaboards (hardy plank).

  11. I have had Trex installed for 10 years. One of the first to try it out.
    I loved it then and still love it now. Looks great. No mold. And is standing up to my New England weather just fine. Sorry to hear about these other folks. I had no Idea. Iv been recommending this product for years. I did get it from a building supply company. Not Home Dogshit! Maybe that has something to do with it lasting?

  12. You should have gone to Vegas - lucky guy. I also purchased "maintenance free" "25 year warranty" Trex decking for my newly purchased home. Thinking it would last until I eventually sold my home. NOT! It is a mess. The decking is on the front entry of my home and it is embarrasing. I cannot afford to pull it out, buy replacement product and pay for labor to replace it. It is all black and spotted and flaking more and more.
    Does anyone have any solid information on the class action suit? Has anyone gotten reimbursement? I am interested in any and all tips on how to proceed. This is a nightmare. And to think I purchased this product only because of the promise of no maintenance and longevity of use.
